Terms of Service

These Terms of Service govern your use of TapQard services provided by Allan Fenton t/a TapQard, Dundee, United Kingdom ("we", "us", "TapQard"). By purchasing a TapQard service you agree to these terms.

1. Services

TapQard provides:

The specific deliverables depend on the package purchased. All packages are described at tapqard.co.uk.

2. Setup and Delivery

Delivery timelines begin from the point all required assets and information have been received, not from the date of payment. We are not responsible for delays caused by incomplete or late submissions from the client.

3. Monthly Subscription

All packages include a monthly subscription of £19.99 which covers hosting, maintenance, and monthly updates. The subscription begins 30 days after the setup fee payment date.

Subscriptions are billed monthly via Stripe. Failed payments will result in a warning email. If payment is not resolved within 7 days, the site and QR code redirect will be temporarily deactivated. Reactivation occurs automatically once payment is resolved.

4. Monthly Updates

4.1 What Is Included

Each monthly subscription includes 2 site updates per calendar month, resetting on your monthly anniversary date.

One update is defined as: one email containing a bundle of requested changes, regardless of the number of individual items within that email, provided the changes are reasonable in scope.

6. Acceptable Use

You may not use TapQard services to promote or facilitate illegal goods or services, defamatory or harassing content, content that infringes copyright or trademarks, or misleading business practices. We reserve the right to refuse or remove content that violates these terms without notice or refund.

7. Payment and Refunds

7.1 Setup Fee

The setup fee is non-refundable once work has commenced. If you cancel before we have started building your site, a full refund will be issued within 5 working days.

7.2 Monthly Subscription

Monthly subscription fees are non-refundable for the current billing period. You may cancel at any time and your service will continue until the end of the paid period.

7.3 The Works Package

Once cards have been sent to print, the printing cost portion (approximately £50) is non-refundable.

10. Intellectual Property

All content you provide (logos, photos, text) remains your intellectual property. The site design and code created by TapQard remains our intellectual property until the setup fee is paid in full, at which point you are granted a perpetual licence to use it for your business. We reserve the right to display your completed site as a portfolio example unless you request otherwise in writing.

11. Limitation of Liability

TapQard is not liable for loss of business or revenue from site downtime, third-party service outages (Stripe, Cloudflare, booking platforms), issues arising from content provided by you, or any indirect or consequential losses. Our total liability will not exceed the total fees paid by you in the 12 months preceding the claim.

12. Availability

TapQard is operated as a sole trader business. We aim to respond to all enquiries and update requests within 2 working days. During periods of holiday or illness, an out-of-office notice will be in place and timelines may be extended accordingly.

13. Changes to These Terms

We may update these Terms from time to time. Active clients will be notified by email of material changes with 30 days notice. Continued use of the service after that date constitutes acceptance of the updated terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
